Terms and Conditions

The introduction

Applicable Terms of Use: You must read the following terms and conditions (“Terms and Conditions”) before accessing the website located at https://sigmarket.com/ and all websites linked to https://sigmarket.com/ (hereinafter referred to as “ Website”) in any way, or download, install or otherwise use the Sigmarket application (“Application”), or use any other software provided by Sigmarket (“Software”) (the Site, Application, and other Software hereinafter referred to as “ Platform”), or access or use any information, services, features or resources available or located through the Platforms on any iOS, Android or other supported electronic device.

Sigmarket Trading and Design Company LLC. It is a limited liability company registered in the State of Qatar with commercial registration number 189962 (hereinafter referred to as “Sigmarket”). It enables Ordering Services (as defined below) transactions to be conducted on its Platform between Suppliers, Manufacturers, Participating Businesses and Merchants, and Users (as defined below). Users may select and place an order (as defined below) from a range of products and services listed and offered for sale by Partner Merchants (as defined below).

In connection with what was mentioned above, Sigmarket provides services for displaying and selling products and services and building a communication network with users (as defined below) by linking them with delivery partners (as defined below), who are responsible for providing pick-up and delivery services for orders, as initiated. By users/partner merchants on the platform.

Sigmarket is not a manufacturer or distributor of the products and services listed on the Platform, but simply facilitates the process of placing an order on behalf of the User to the Partner Merchant in accordance with the contract for the sale and purchase of goods and services between the User and the Partner Merchants.
For the avoidance of doubt, Sigmarket acts only as an intermediary to facilitate transactions between Users and Partner Merchants (and/or anything related thereto). It is particularly clarified that Service Providers (as defined below) are independent contractors and are free to determine how they operate. Sigmarket does not exercise any control over the service providers. The relationship between Sigmarket and the Service Providers is not that of employee and employer or joint partners.

Acceptance: These Terms and Conditions constitute a legal and binding agreement between Sigmarket and the User. When installing, downloading or using the Platform and the Application, the User has entered into a contract with Sigmarket and is deemed to have read, understood and accepted the Terms and Conditions and agreed to be bound by them. If these Terms and Conditions (or any part thereof) are not acceptable to you, that person must not access or use or continue to access or use the Platform. In any event, Sigmarket reserves the right to suspend or terminate access to or use of all or any part of this Platform at any time, without any liability to the User and/or any other person.

Updates to these Terms and Conditions: Sigmarket reserves the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes on the Platform, with or without notice to Users. Any new features or tools added to the Platform shall also be subject to these Terms and Conditions. Any new version of these Terms and Conditions will be effective and govern the use of the Platform and the User's relationship with Sigmarket, immediately upon posting of such revised version on the Platform. The User's continued use/access of the Platform after any change is lifted constitutes acceptance of those changes.

1. Definitions

For the purpose of these terms and conditions:

1.1 “Account” means a user account that is created by the User.

1.2 “Affiliates” will mean any natural person, corporation, partnership, limited liability company, association, trust, statutory entity or other legal entity that directly or indirectly through one or more intermediaries controls, or is controlled by or under the common control of Sigmarket.

1.3 “Application” refers to the Sigmarket Application.

1.4 “Applicable Laws” means all laws, regulations, guidelines and legal notices issued by the State of Qatar.

1.5 “Breach of Authorization” means any cancellation or attempted cancellation of an Order by the User that constitutes a violation of the irrevocable and unreviewed authorization in favor of Sigmarket to place the Order on behalf of the User’s business partners.

1.6 “Data Protection Legislation” includes (a) the law of the State of Qatar and (b) any legislation in force from time to time relating to privacy and/or processing of personal data applicable in connection with the provision and receipt of Training within the framework of these Terms and Conditions.

1.7 “Delivery Partners” includes any third party service provider whether an organization or individual that partners with Sigmarket to provide pickup and delivery services for orders, as initiated by Users/Business Partners on the Platform.

1.8 “Delivery Services” means any pickup and delivery services provided by Delivery Partners for orders placed by Users/Business Partners on the Platform in the State of Qatar.

1.9 “Feedback” means any ideas or suggestions sent to Sigmarket through the Suggestions, Feedback, Wiki, Forum or similar pages.

1.10 “Order Services” means the services advertised and marketed by Business Partners, including, without limitation, (a) food and beverages, (b) consumer goods, and (c) other products and services available to order from accepted by the User on the Platform which Business Partners may or may not accept at their sole discretion.

1.11 “Order” refers to the Service request made by the User on the Platform.

1.12 “Business Partners” includes all organizations and merchants, including but not limited to suppliers, factories, wholesalers, distributors and agents, who participate in connection with the Ordering Services. The term "dealer partner" can refer to any of them.

1.13 “Privacy Policy” means Sigmarket’s Privacy Policy.

1.14 “Service Providers” includes and refers to business partners and delivery partners if any.

1.15 “Sigmarket Materials” means any products, images, photographs, including any person represented in the images, illustrations, icons, text, video clips, music, written materials and other materials owned by Sigmarket or its affiliates.

1.16 “Services” includes the services provided by Sigmarket on the Platform including ordering services.

1.17 “Sensitive Information” includes customer private information, including but not limited to debit card numbers and credit card numbers.

1.18 “Terms and Conditions” refers to these Terms and Conditions.

1.19 “User” or “Customer” refers to any person who accesses or uses the Services for the purpose of sharing, viewing, hosting, publishing information, conducting transactions, or uploading information, opinions and images.

1.20 “We” refers to Sigmarket.

1.21 “You” refers to a user.

2. Representations and warranties

The User's order to purchase products and services from a Merchant Partner by clicking on the “Place an Order” mark (or any other button indicating the placement of an order) on the Merchant Partner's page on the Platform will constitute a non-conditional and irrevocable authorization issued by the User to Sigmarket to place online orders. For services to the relevant Merchant Partner and Delivery Partner if any on behalf of the User. When an order is placed on behalf of the User by Sigmarket and accepted by the Merchant Partner, the order constitutes a separate contract for the sale of the goods.

The Platform is provided to the User at Sigmarket's sole and absolute discretion. Sigmarket does not represent that all features available in the Application will also be available on the Website, or vice versa.

By using the Platform in any way or taking any action indicating your acceptance of the Terms and Conditions (including accessing or using the Platform), or completing the account registration process, you “User” represent and warrant that:

- I have read, understood, and agree to comply with these Terms and Conditions and any future amendments and additions to these Terms and Conditions, as published from time to time on https://sigmarket.com/ or through the Services.

- You are eighteen (18) years of age or older.

- That you are able to enter into a legal agreement.

- You are not legally barred or otherwise prohibited from accessing the Platform in the jurisdiction in which you reside.

- You have the authority to enter into the Agreement personally and, if applicable, on behalf of any company, organization or other legal entity named as a User during the account creation process with Sigmarket and to bind that company, organization or entity to the Terms and Conditions.

- Your participation in using the Services is for personal or internal business use. When using the Services, you agree to comply with all applicable laws in your country of origin and the country, state and city in which you reside while using the Services.

- You may access the Services only using authorized means. It is your duty to check to ensure you download the correct software for your device. Sigmarket is not responsible if you do not have a compatible device or if you download the wrong version of the software for your device. Sigmarket reserves the right to terminate your use of the Software and/or Services if you use the Software or Services with an incompatible or unauthorized device.

- By using the Services, you agree to the following:

   - You will only use the Services for lawful purposes; You will not use the Services to send or store any material that is illegal or for fraudulent or deceptive purposes.
   - You will not use the Services to cause annoyance or inconvenience.
   - You will not copy or distribute the Software or any content offered through the Services without prior written permission from Sigmarket.
   - You will not create or compile, directly or indirectly, any collection, supplement or other directory of any Content viewed through the Services except for your personal, non-commercial use.
   - The information you provide to us when you create an account or communicate with us in any way is accurate, and you will promptly notify us of any changes to that information, and you will provide us with any proof of identity that we may justifiably request from you.
   - You will keep your account password or any identification data we provide to you that enables you to access the Services securely and confidentially.
   - You will not use the Platforms or Software in any manner that could cause damage to any Sigmarket server or the networks connected to any Sigmarket server.
   - You will not attempt to access any part of the Platform and/or any service, account, resource, computer system and/or network connected to any Sigmarket server without permission.
   - You will not drill down or access the Platform manually, or use any robot, spider, scraper, automated process, and/or device to scrape, copy or monitor any part of the Platform, or any content on the Platform, unless you grant us Sigmarket provides permission to do so in writing.
   - You will not copy any content viewed through the Services, including but not limited to the content of Provider listings and reviews, for republication in any form or media.
   - You will not perform any systematic retrieval of data or other content from the Platform, Software or Services.
   - You will not attempt to harm other users, Sigmarket, the Platform, the Software or the Services, in any way whatsoever.
   - You will report any bugs, software errors, unauthorized access methods, or any violation of intellectual property rights that you discover while using the Platform, the Software or the Services.

3. User account

3.1 Access License:
You expressly agree that Sigmarket may, through automated means, access your messages on your mobile device and mobile phone number and retrieve and use information from your messages to provide you with enhanced services from Sigmarket or its affiliates. For example: One Time Password is the OTP provided for 2-Step Verification. By allowing us to access your messages, you understand that we may access, fill out and send the OTP from the message received on your mobile device for 2-Step Verification.

3.2 Accuracy of information:
You agree that any Registration Information/User Content you provide to us will always be true, accurate, intact, complete and up-to-date. Any phone number used to register on the Platform must be registered in your name, and you may be asked to provide supporting documentation to prove this. Users understand and agree that Users are responsible for the accuracy of all information they provide to obtain the Services.

The User must ensure that details such as contact number, delivery address etc. are accurate and correct when placing the order. By providing these details, the user expresses his agreement to Sigmarket's terms and conditions and privacy policies.

We reserve the right to suspend or terminate your account and your access to the Services if:

- Any content provided by the user during or after the registration process proves to be inaccurate, not current or incomplete;
- If you believe that your actions may create legal liability for you, other users or us; wow
- If you are found not to be in compliance with these terms and conditions.

4. Use of the platform

4.1 Services:
Through the Platform, Sigmarket will offer you a portal to order a product or service online of your choice provided by merchant partners. Users may access ordering services provided by Merchant Partners listed on the Platform and submit an order to Merchant Partners through the Platform which Merchant Partners may accept or reject based on their own choice.

4.2 Requests:
When you order a product or service via our Platform, you will receive a notification from Sigmarket on behalf of the trading partner confirming that your order has been received and accepted by the trading partner (confirmation email). The contract for the provision of any (a) Products, (b) Consumer Goods, and (c) other products and services will be solely between you and the Business Partner and will only be created when we send you the confirmation email. Please ensure you provide a valid email address as we will contact you about your request. Please, also make sure you provide a correct address and phone number to ensure your ordering services go to the right place. If you do not receive the order, incorrectly register the delivery address, or respond to a telephone correspondence within 10 minutes of our delivery partners arriving at your address, we reserve the right to leave the premises, and you will be charged for the product, order or service.

4.3 User Content:
Sigmarket may offer you interactive opportunities through the Services, including, for example, the ability to post user ratings and reviews. You represent and warrant that you are the owner of, or otherwise have the right to submit, all User Content that you submit, post, transmit or otherwise make available through the Services. You hereby grant to Sigmarket a perpetual, non-revocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully sublicensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works from, distribute and/or otherwise use the User Content in connection with the Sigmarket business and in all forms now known or hereafter known. for future invention(s), without notice and/or consent from you. You also grant Sigmarket a license to use your user name and/or other user profile information, including without limitation your review history, to attribute User Content to you in connection with such uses, without notice or consent from you.

4.4 Notes:
You agree that any submission of ideas, suggestions, and/or proposals to Sigmarket through suggestion pages, submissions, wikis, forums, or similar pages (“Feedback”) is at your own risk and that Sigmarket has no obligations (including without Limited obligations of confidentiality) in relation to these notes. You represent and warrant that you have all rights necessary to submit such Feedback and hereby grant to Sigmarket a perpetual, non-revocable, transferable, fully paid-up, royalty-free, non-exclusive, worldwide, fully licensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute and/or otherwise use such Notes.

4.5 Ratings and Reviews:
In connection with ratings and reviews that you are asked to provide to Service Providers or other businesses (“Ratings” and/or “Reviews”), such Content is considered User Content and is subject to these Terms and Conditions. Ratings and reviews are not endorsed by Sigmarket and do not represent the opinions of Sigmarket or its affiliates. Sigmarket is not responsible for ratings and reviews or any claims for economic loss resulting from such ratings and reviews.

Because we strive to maintain a high level of integrity regarding ratings and reviews posted or otherwise made available through the Services, you agree that you:

- Any evaluation or review will be based on personal experience from the service provider or business.
- You will not provide a rating or review of any service provider or business in which you have a financial interest, employment relationship, employment, or other affiliation, or of any competitor of this company.
- You will not provide a rating or review in exchange for payment, free products or services, or other benefits from a service provider or business.

5. Payment

5.1 Prices:
- All commercial/contractual terms are presented and agreed upon between the user and the service providers only regarding the products and services provided by them. Commercial/contractual terms include without limitation: price, applicable taxes, delivery charges, payment terms, delivery date, delivery period, delivery method, warranties related to the products and services and after-sales services related to the products and services. Sigmarket has no control or role in determining or directing any kind of such commercial/contractual terms between the User and the Service Providers. However, Sigmarket may provide support services to Service Providers with respect to order fulfillment, payment instrument, payment collection, customer service center and other accompanying services, in accordance with independent contracts executed between Sigmarket and the relevant Service Providers. The price for the products and services offered by the merchant partners is determined by the merchant partners themselves, and Sigmarket has no role in determining the price in any way.

Sigmarket takes care to verify the accuracy of all prices listed when published, as received from merchant partners. The total price of the products and/or services ordered, including delivery and other costs, will be displayed on the Platform when you place your order.

Prices for menu items displayed through the Services may differ from prices provided or published by merchant partners for the same menu items and/or from prices available on other third-party websites, and such prices may not be the lowest prices at which the menu items were sold.

Sigmarket has no obligation to detail its costs, profits or margins when publishing such prices.

Sigmarket reserves the right to change these prices at any time, at its discretion. You are responsible for all transaction taxes on the Services provided under these Terms and Conditions (excluding taxes based on Sigmarket income). Payment will be processed by Sigmarket, using the preferred payment method, allocated in your account.


5.2 Promotions:
Sigmarket and/or merchant partners may, in their sole discretion and discretion, offer promotions with different features and different prices to any of our users. These promotions, unless offered to you, in no way affect your offer or contract. However, the validity and verification of such offers will be subject to the compliance of service providers/payment partners/third parties, and Sigmarket does not bear any responsibility for such offers.

5.3 Loyalty Points Program:
Sigmarket, at its sole discretion, may offer a loyalty points program to users. Program details are subject to change from time to time. Points will be allocated for each order placed. Points may be redeemed against payment for services on the Platform and/or other benefits/discounts thereon, subject to the conversion price/conditions of the offer, as may be amended from time to time by Sigmarket.

5.4 Services and software fees:
Sigmarket may change the fees for the Services as it deems necessary or appropriate for the project.

5.5 Payment method:
We accept online payments through third party payment methods such as, but not limited to, Visa, MasterCard, Wallet (as defined below), Apple Pay, Google Pay and CWallet. By placing an order on the platform, you ensure that:

- All information provided to us by you for payment is accurate and correct.
- The account you use to pay for the service contains sufficient funds to cover the entire transaction amount, and is active and not expired or cancelled.
- You are the owner (or authorized user) of the account you use to pay your order, and you authorize that the full transaction amount for your order will be collected on your designated account.

All payments for purchases made on the Platforms may be processed through third-party e-commerce vendors. If you pay by credit card, we may perform a basic preliminary check on your payment card to check that there are sufficient funds to complete the transaction. If your card issuer declines or does not authorize the payment for any reason, you will receive immediate notification of this during the payment process. Your payment method may also be declined if:

- The payment invoice provided did not match the bank records.
- Your card has expired or been canceled by the issuing bank; Or a possible fraud or security issue has been detected on your card.

After successful payment, your credit card or account (as applicable) will be charged for the full transaction amount. “Payment completed successfully” means that the following occurred:

- Confirm and submit your purchase.
-We accept your transaction successfully.
- If you paid with a credit card, we will successfully conduct a preliminary check on your card.

  
5.6 Modifying and canceling the order:
Modification of requests will only be accepted if approved by the service provider. If this modification is not accepted, the User must not cancel the order. In accordance with the cancellation policy as stated below, the User can cancel the order if:

- Inability to contact the merchant by phone or email.
- Unavailability of products and services in the list.
- Providing false information.
- Wrong order delivered.
- The ordered products and services were damaged or the packaging was opened during delivery.
- The quantity of some items in the order made by the user has expired.

5.7 Lack of access to the client:
In the event that a representative of the Merchant, Business Partner or Delivery Partner arrives at the delivery address provided by the User on the Platform in a timely manner and is unable to reach the User within a period of 10 minutes, the order will be deemed delivered and will be returned to the Business Partner. No refunds will be available in the above case.

5.8 Use of Sigmarket Wallet
The Platform provides you with the option to use the Sigmarket Wallet (“Wallet”) once you create an account on the Platform. You can link your credit card or debit card (hereinafter referred to as the “Card”) to the Wallet by clicking on the “+” button, after which you will be redirected to a new page. The page will have two main headings, "Fill" and "Convert." The transaction history page is available on the wallet page.

Under the “Fill” heading, you are allowed to add any amount of money (only in Qatari Riyals) in the box next to the option labeled “Amount”.

When you enter the amount in the box labeled “Amount”, you will be directed to the payment gateway which will ask you to provide your card details. You must take reasonable care to ensure the accuracy and authenticity of the card details provided by you while using the Wallet to avoid any ambiguity or future payment issues.

Once we receive your wallet payment instructions, it is usually not possible to change any details in those instructions. You will have the opportunity to confirm payment instructions before submitting them and you should check the details carefully.

The amount added to the wallet can be used to make payment for any order placed through the platform. In cases of order cancellation for a canceled order using the amount in the wallet, the cancellation amount will be refunded back into the wallet.
If you activate the transfer service under the heading “Transfer”, the wallet balance will be displayed. In order to give any other user any amount from your money in the wallet, you will be asked to enter your friend’s Qatari mobile number and mention the amount you wish to give. When you click on the “Continue” option, you will be redirected to a page confirming the payment details. This option can only be availed if you have a minimum balance of QAR 1,000 in your wallet.

Under the “Transactions” heading, your transaction records will be displayed; You are responsible for reviewing your transaction activity for errors or unauthorized transactions and for notifying us of any such event, in accordance with Sigmarket's terms and conditions.

We reserve the right to change, suspend or discontinue any part of the Wallet at any time, including the operating hours or availability of the Wallet Services or any feature therein, without notice and without liability. We also reserve the right to impose limits on certain features or restrictions on access to parts or all of the Service without notice and without liability. We may refuse to process any payment without any prior notice if you breach these terms and conditions.

We do not guarantee that the Wallet-related Services will be continuous or error-free, and we will not be liable for interruptions in service (including, without limitation, power outages, system failures, or other interruptions that may affect the receipt, processing, acceptance, completion or settlement of payment transactions).

You acknowledge and understand that the Wallet is associated with your Account and that you will be fully responsible for any liability arising from misuse of your Account.

You will be entirely responsible for any unauthorized access to or use of your personal or financial information through your wallet on the Platform. To help you prevent unauthorized use of your wallet on the platform, you must comply with the security measures recommended by Sigmarket. If you believe that your wallet on the Platform has been accessed or used in an unauthorized manner, please contact Customer Service immediately.

5.8 Use of Sigmarket Wallet
The Platform provides you with the option to use the Sigmarket Wallet (“Wallet”) once you create an account on the Platform. You can link your credit card or debit card (hereinafter referred to as the “Card”) to the Wallet by clicking on the “+” button, after which you will be redirected to a new page. We do not guarantee that the Wallet-related Services will be continuous or error-free, and we will not be liable for interruptions in service (including, without limitation, power outages, system failures, or other interruptions that may affect the receipt, processing, acceptance, completion or settlement of payment transactions).

You acknowledge and understand that the Wallet is associated with your Account and that you will be fully responsible for any liability arising from misuse of your Account.

You will be entirely responsible for any unauthorized access to or use of your personal or financial information through your wallet on the Platform. To help you prevent unauthorized use of your wallet on the platform, you must comply with the security measures recommended by Sigmarket. If you believe that your wallet on the Platform has been accessed or used in an unauthorized manner, please contact Customer Service immediately.

6. Third Party Service Providers

You acknowledge and agree that Sigmarket facilitates the hosting of the products and services offered by the Service Providers and that Sigmarket does not:

- Provides no guarantees, whether express or implied, regarding the quality of the products and services provided by service providers.
- Recommends or confirms that a particular product or products and/or services offered or provided by the Service Provider meet a certain quality or are labeled in a certain format.
- Bear any responsibility if the products and services provided by the service provider do not meet the user's expectation or if the user suffers any loss or damage, including any physical injury, as a result of the use of such products and services.
- Bears any responsibility in the event of changing, modifying or replacing the products and services provided by the service provider.

Sigmarket will not evaluate the suitability, legality or capacity of any Service Provider. Sigmarket is not responsible for a participating company's order preparation or safety and does not verify its compliance with applicable laws or regulations. Sigmarket has no responsibility or assumes any liability for the actions of third party service providers, except as set forth herein.

You may be required to provide sensitive information to approved payment gateways while making a payment. In this regard, you agree to provide your card details correctly and accurately to the approved payment gateways to avail the Services. The information you provide will not be used for any third party unless this is done in connection with fraud verification, or pursuant to law, regulation, or court order. You will be entirely responsible for the security and confidentiality of your card details. We expressly disclaim all liability that may arise as a result of any unauthorized use of your Card.

The platform is not equipped or authorized to conduct any financial transaction. All payments will be made through the payment gateway. Payments received through the payment gateway or other authorized payment system will be processed by Sigmarket to merchant partners. The receipt for these payments will be issued directly to you by the merchant partners. Please be sure to request an invoice from our merchant partners.

We do not recommend any service provider. In addition, although these Terms and Conditions require that you provide accurate information, we do not attempt to verify, nor do we verify, whether an identity is fraudulent.

You agree not to attempt to impose liability on us or seek any legal remedies on our part with respect to any acts or omissions on the part of the Service Provider.

7. Third-Party Sites, Applications and Third-Party Ads

The Services may contain links to third-party websites (“Third-Party Sites”), third-party applications (“Third-Party Apps”) and advertisements from third parties (“Third-Party Ads”) (collectively “Third-Party Sites & Ads”). When you click on a link to a Third Party Site, Third Party Application or Third Party Ad, Sigmarket will not warn you that you have left the Sigmarket Platform or Services and will not warn you that you are subject to the terms and conditions (including privacy policies) of another website or web destination. 7.1 Legal Compliance by Merchant Partners
The User acknowledges that Sigmarket has no responsibility for compliance with rules, regulations and legal licenses by the Service Providers. The User agrees that Sigmarket will not be liable in any way if the User is unable to benefit from the offers provided by the Service Provider due to the Service Provider's violation of any legal rule, regulation or legal license.

7.2 Fraud or Unauthorized Use
You will be entirely responsible for any unauthorized access to or use of your personal or financial information through your account, including any loss, damage or claim suffered or made against any of the Service Providers and/or Sigmarket, due to or resulting from such use. / Unauthorized access. You agree not to remove, obscure or alter Sigmarket's or any third party's copyright, patent or trademark notices attached to the Platform or accessed or used in conjunction with this Platform. Except as expressly authorized by Sigmarket, you agree not to sell, license, distribute, copy, modify, publicly perform, display, publish, edit, adapt or create derivative works. In an unauthorized manner, or make unauthorized use of the Sigmarket Materials.

9. Compensation

You agree to indemnify, hold harmless Sigmarket from and against all claims, losses, damages, liabilities, costs and expenses, including without limitation, legal fees and expenses, arising out of or in connection with: (a) your use or misuse of the Platform; (b) any violation by you of these Terms and Conditions or any other policies applicable to your use of the Platform; or (c) any breach of the representations, warranties and covenants made by you herein. Sigmarket reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Sigmarket, including the right to settlement, and you agree to cooperate with Sigmarket in the defense and settlement of such claims. Sigmarket will use reasonable efforts to notify you of any claim, action or suit brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall remain in effect after the termination of these Terms and Conditions.

10. Privacy and Communications

Privacy Policy: Our information collection practices on the Platform, such as the types of information we collect about visitors on the Platform and the ways we use that information, are governed by the provisions of our Privacy Policy.

Data Transfer: Sigmarket may share your payment-related information with banks, third-party service providers and service providers who are required to carry out operations, process payments and promote the Services.

Sigmarket shall not be responsible in any way for any acts or negligence of the Service Providers including service defects, wrong order delivery, quality of the products, time taken to deliver the product or service etc.

Furthermore, we will not be liable for any business loss (including loss of profits, revenue, contracts, prospects, data, reputation or wasted expenditure) or any other indirect or consequential loss that could not have been reasonably foreseen by the parties when they started using the Platform.

You know that you, as a user, are subject to the provisions of the Human Food Control Regulation and its amendments. It is known that some foods may be suitable for certain age groups only. The User must check the products he is ordering and read their description, if available, before placing an order on the Platform. Sigmarket will not be responsible if the product or service ordered by the user does not comply with his dietary requirements or any other requirements and restrictions.

Sigmarket will not be responsible in any way for any personal interactions with representatives or employees of the Service Providers or the user's experience at the Service Provider's outlet. Sigmarket will not be responsible in any way if any outlet of the Service Provider is closed temporarily or permanently. Sigmarket will only take care of the demands and liabilities arising from the offers and membership plans advertised exclusively by Sigmarket.

We expressly exclude all liabilities that may arise as a result of unauthorized use of credit/debit cards. You are aware that services from third parties are available on the Platform. We may form partnerships or alliances with some of these third parties from time to time to facilitate the provision of certain services to you. However, you acknowledge and agree that at no time do we make any representations or warranties regarding third party services, and we will not be liable to you or any third party for any consequences or demands arising out of or in connection with such third parties including, but not by way of Limitation of any liability for death, injury or damage suffered by you or any third party. Any rights and claims you may have against us with respect to Third Party Services are hereby expressly terminated and waived.

The list of products and services displayed on the Platform is provided “as is”. We and/or our employees make no warranty, representation regarding the quality, timeliness, content, packing or efficiency of the service, wrong order delivery, delay in order execution or delivery, order damage etc.

In no event will we be liable for any damages (including, without limitation, direct, indirect, incidental, special, consequential or exceptional damages, damages for personal injury/wrongful death, damages for loss of profits, loss of data or Business Interruption), resulting from any services provided by any Service Provider through the Platform, whether in reliance on warranty, contract, award (including negligence) or any other legal theory and whether or not we are aware of the possibility of such damages. Sigmarket attempts to ensure that the information provided is accurate and complete. However, Sigmarket does not warrant or represent in any way that the Platform is accurate, error-free or reliable or that use of the Sigmarket Materials will not infringe the rights of third parties.

Sigmarket does not warrant that the functional and/or technical aspects of the Platform or the Materials made available by Sigmarket will be error-free or that Sigmarket, the Sigmarket Materials or the servers that make them available are free of viruses or other harmful components. If use of the Platform or the Sigmarket Materials results in the need for servicing or replacing property, materials, equipment, data, or any other item, Sigmarket is not responsible for those costs. without limiting the foregoing, everything on the platform is provided to you on an “as is” and “as available” basis to the fullest extent permissible under applicable law, without warranty of any kind, either express or implied, including, but not without limitation, the implied warranties of merchantability, acceptable quality, fitness for a particular purpose, reasonable care and skill, or non-infringement. Sigmarket and its suppliers make no warranty about the Sigmarket materials, software, text, downloads, graphics, and links, or about the results that may be obtained from using the platform.

To the maximum extent permissible under applicable law, Sigmarket will not be liable for any indirect, incidental or consequential damages in any way arising out of or in connection with the use of the information available on the Platform or any liability relating to loss of use, business interruption, or loss of profits. , loss of data, or any other indirect or consequential loss that could not have been reasonably foreseen by both parties when starting to use the Platform.

12. Things out of control

13. Termination and suspension

These Terms and Conditions shall be governed, construed and enforced in all respects in accordance with the laws of the State of Qatar. You irrevocably consent to the exclusive jurisdiction of the court of the State of Qatar in connection with any action to enforce the provisions of these Terms and Conditions, or to recover damages or any other settlement due to the breach or violation under these Terms and Conditions, or for any other cause arising under these Terms and Conditions.

14. Exemption

Sigmarket's failure to exercise or enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or action. Any waiver of any provision in these Terms and Conditions will be effective only if in writing and signed by Sigmarket.

15. Detachable part

If any provision of these Terms and Conditions is held invalid or unenforceable, then that provision will be severed from the remaining Terms and Conditions, and this will not affect the validity, force or enforceability of the remaining provisions.

 16. Cancellation Policy

⦁ If you change your decision after creating the order and decide to cancel the order, you can do so in a timely manner by clicking on “Cancel Order” before the trading partner accepts the order within the time allotted for cancellation. You will not be held accountable for the canceled order, and if you paid the value of the order through any electronic, bank, or online payment method, such as but not limited to bank cards, credit cards, and other electronic payment methods, the amount paid will be refunded to the wallet.

⦁ If you decide to cancel the order after the trading partner has accepted the order, you will not have the option to “Cancel Order” on the Platform. However, you can still cancel the order by contacting the Sigmarket Customer Center and providing a brief description of the reason for cancellation. Sigmarket will decide in its sole discretion whether to cancel the order based on the reason for cancellation. If Sigmarket accepts the cancellation of your order, if the payment is through any electronic, bank or online payment method, such as but not limited to bank cards, credit cards and other electronic payment methods, you will receive a full refund of the amount paid to the wallet.

⦁ All refunds will be processed in the same way as payment unless user refunds are provided in the wallet. Any refunds made will be returned to the wallet within 24 hours of order cancellation.

If the payment is refunded to the User's credit card, debit card or Apple Pay, Sigmarket will quickly initiate the refund process with the User's bank. The time it takes for your refund to appear in your bank account can usually range between 3 and 10 business days. This time frame depends on the bank's processing time and its own policy.

It is important to note that if part of the order was paid using the wallet, the user cannot request that this part of the money be transferred to his credit card. Instead, the refund will be credited to the wallet.

⦁ The User must be aware that any cancellation or purported attempt to cancel the order after the Delivery Partner has sent the Business Partner to deliver the order. Such an order would constitute a violation of the User's irrevocable authorization to Sigmarket to place such order to the Business Partner on behalf of the User (“Breach of Authorization”). In the event that the User commits a violation of authorization, he will be liable to pay agreed compensation in an amount equal to the value of the order. The User shall be obligated to authorize Sigmarket to deduct or collect the amount due as specific compensation by such means as Sigmarket may decide in its responsibility, including but not limited to, by deducting such amount from the payment pursuant to which the User's next order was made.

Fees paid by you for final completed and delivered orders are non-refundable. Sigmarket has no obligation to provide refunds or credit, but may grant them, in each case in Sigmarket's sole discretion.

 

17. Missing item or partial cancellation

⦁ In the event that an order is received that contains a missing item, the user has the right to request a new item or a refund in the following cases:

⦁ If Sigmarket believes that the order placed by the User contains a missing item and the User is notified of the missing item by Sigmarket’s Customer Service Centre; or

⦁ If the user receives an order and discovers that there is a missing item in the order, the user notifies Sigmarket’s customer service center of the missing item, and this notification is verified and accepted by Sigmarket.

⦁ In the above cases, the User has the option to receive a partial refund equivalent to the cost of the lost item in the User's Wallet or to receive a replacement for the lost item. However, if the user creates the order by paying in cash, and there are missing items, the customer will have to pay the difference between the order and the value of the missing item.

18. Return Policy

⦁ How do I initiate a return or exchange?

    To initiate a return or exchange, simply contact our Customer Service. All you need is your Sigmarket receipt and order number. If you don't know your order number, you can usually find it at the top of your Sigmarket receipt. If you can't find it, you can contact us via customer service.

 

19. Susceptibility/eligibility for return

    Before contacting our customer service, please follow these instructions to make sure your order is eligible for a return:

    - Returned items must be unopened.
    - Returned items must be returned in perfect condition, with original packaging and condition and all paperwork attached.
    - Returned items must not show obvious signs of use, spoilage, vandalism, neglect, or alteration in appearance.

    - After contacting us, an investigation case will be opened in coordination with the merchant. When your return request is accepted by the merchant, we will process the return and issue a refund.

    - All refunds will be disbursed according to the following schedule:

        - Sigmarket wallet: 24 hours
        - Bank account (from Qatar Islamic Bank to Qatar Islamic Bank): 72 hours.
        - Bank account (from Qatar Islamic Bank to another bank): 3-10 working days.
        -Debit/Credit Card: 3-10 business days.

    - Products purchased at promotional prices are refunded the purchase amount based on the same purchase price.


20. Valid reasons for returning the item:

- All decisions regarding returns will be at the discretion of Sigmarket in accordance with Sigmarket's internal returns policy, and this decision will be final and binding.

- Sigmarket cannot guarantee the quality of products delivered by third party merchants. If you believe that your item may be at risk of a manufacturing defect, you may contact us at any time and we will be happy to assist you. To return the item, the customer must meet one of the categories listed below:

- Your existing item has a manufacturing defect. A manufacturing defect is damage caused by an error by a merchant. Examples of manufacturing problems include; In materials, design, and/or workmanship.

- Your item is damaged (i.e. destroyed or physically broken) / defective (i.e. unable to operate).

- Your item is incomplete (i.e. missing components and/or accessories).

- The item you have is incorrect (i.e. wrong product/size/color, counterfeit, or expired).

- The item you have does not match the product description or picture (i.e. the item found is not as advertised).

- Sigmarket reserves the right to suspend or terminate any refund immediately without prior notice if the refund violates the terms and conditions of this return policy or in case of suspicious activities, misrepresentation by the customer, and fraudulent activities.

- You agree to indemnify Sigmarket from any and all claims, suits, liabilities, judgments, losses and damages arising out of or in connection with any claim or suit related to this return policy.
